Terms of Service

These Terms are an agreement between Youhexa Technologies Pvt. Ltd. ("DavaSetu", "we") and (a) pharmacies that subscribe to DavaSetu ("Subscribers") and (b) people who visit websites hosted on DavaSetu ("Visitors"). By using DavaSetu, you agree to these Terms.

Part A — For Pharmacy Subscribers

The following sections apply to pharmacies that subscribe to DavaSetu.

A1. What DavaSetu provides

DavaSetu is a software tool. Its features are: a pharmacy information website on a DavaSetu subdomain (and a custom domain on eligible plans); a dashboard to enter pharmacy, licence and pharmacist details; inventory management, Excel/CSV import and weekly stock publishing; a printable QR code; reminders and internal readiness indicators.

DavaSetu does not: sell, dispense, prescribe or deliver medicines, take orders, or accept prescriptions; provide legal, regulatory or compliance advice; verify licences or registrations on behalf of any government authority.

A2. No government approval or compliance guarantee

DavaSetu is not affiliated with, approved by or endorsed by the UP FSDA, any drug control authority or any government body. The readiness indicators in the dashboard (such as "Complete", "Action required", "Overdue" or "Under review") are internal tools to help you track your own information. They are not official certification. They are not a statement that you meet any law, order or circular. Rules and official requirements can change. You are responsible for checking the current requirements with the relevant authority or your own adviser.

A3. Your responsibilities

You agree that: (1) You are authorised to run the pharmacy and to act for it. (2) You alone are responsible for the accuracy, completeness and timeliness of everything you publish, including licence details, pharmacist details, stock data, and any prices or MRP you choose to display. (3) You will update your stock information as often as your obligations require. DavaSetu will not mark stock as updated unless you publish it. (4) You have obtained the informed consent of each pharmacist before publishing their name, registration number and photograph (see the Pharmacist Consent Notice). You will remove their details when they leave or withdraw consent. (5) You will not publish false, misleading or unlawful content, or another person's documents or data without permission. (6) You will not use DavaSetu to advertise or sell medicines online, take medicine orders, offer prescription services, or make medical or "government verified" claims. (7) You will keep your login details secure and are responsible for activity by your staff accounts.

A4. Our internal review

We may review the details and documents you submit before your website goes live, or at any time after. A review by us is not official verification, and we do not label your data as government-verified. We may delay, reject, unpublish or suspend a website that appears incomplete, inaccurate, misleading, unlawful or in breach of these Terms.

A5. Subscription, payment and renewal

Plans and prices: fees as shown on the billing page at checkout, billed yearly. All plan prices are exclusive of GST. GST at 18% is charged in addition and shown separately on the invoice.

How to pay: subscriptions are paid only through Razorpay. By paying, you also accept Razorpay's applicable terms. We do not accept cash, UPI or bank transfers made outside Razorpay as subscription payments.

Activation: your subscription starts once Razorpay confirms your payment to us. A browser "success" screen or a payment screenshot on its own does not activate a subscription. A DavaSetu administrator may also activate or extend a plan manually, for example to fix a technical problem or as a goodwill extension. That is an internal admin action and not a payment method.

Subscriptions run for one year from activation. Renewal is manual. We never charge you automatically. We will send reminders before expiry, and you renew by paying for a new term.

Plan changes: you can upgrade to a higher plan during a term. The unused part of your current plan is credited pro-rata against the upgrade. Downgrades are not available mid-term, but you can choose a lower plan when you renew.

If a subscription expires or a payment fails, your public website stays live for a grace period of 7 days. After that it may be unpublished until you renew. Your data is retained as described in the Privacy Policy.

Refunds and cancellations follow the Refund & Cancellation Policy.

A6. Your content and licence to us

You keep ownership of your content. You give us a non-exclusive licence to host, store, process and display it for the purpose of providing DavaSetu to you. This licence ends when your content is deleted, except for backups, legal records and unchangeable publication history kept as described in the Privacy Policy.

A7. Subdomains

Your subdomain is assigned for use while your subscription is active. We may refuse or change subdomains that are misleading, offensive, reserved, or that infringe another person's rights.

A8. Service availability

We try to keep DavaSetu available but do not promise uninterrupted or error-free service. Maintenance, outages of third-party providers or events beyond our control may affect availability.

A9. Suspension and termination

You may close your account at any time from the dashboard or by writing to support@davasetu.co.in. We may suspend or terminate an account for breach of these Terms, non-payment, unlawful use, or if required by law. Where reasonable, we will give notice first.

A10. Limitation of liability

To the extent permitted by law: DavaSetu is provided "as is". We are not liable for any penalty, action or loss arising from the content you publish or from whether your business meets regulatory requirements. We are not liable for indirect or consequential losses. Our total liability to you for any claim is limited to the subscription fees you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited under Indian law.

A11. Indemnity

You agree to compensate us for claims by third parties (including pharmacists or authorities) that arise from content you published or from your breach of these Terms.

Part B — For Visitors to Pharmacy Websites

Each pharmacy website on DavaSetu is published and maintained by that pharmacy. DavaSetu only provides the technology.

Pharmacy details, licence numbers, pharmacist details, stock listings and any prices are provided by the pharmacy. DavaSetu does not independently confirm them and does not guarantee that they are accurate, complete or current. A medicine shown as "in stock" may have changed since the date shown. Please confirm availability and price directly with the pharmacy. If you want to check a licence, ask the relevant authority.

You cannot buy, order or reserve medicines through DavaSetu websites. Nothing on these websites is medical advice. Always consult a registered medical practitioner or pharmacist.

Do not misuse the websites. This includes scraping in bulk, attempting to access non-public areas, uploading malicious code, or using pharmacist details to harass anyone.

If you think information on a pharmacy website is wrong, misleading or published without consent, contact the pharmacy. You can also report it to us at support@davasetu.co.in.

Part C — General

Governing law and jurisdiction: These Terms are governed by the laws of India. The courts at Lucknow have exclusive jurisdiction, subject to any rights you have under consumer protection law.

Changes: We may update these Terms. If we make material changes, we will notify Subscribers in advance by email or in the dashboard.
